Terms & Conditions

Version 2.3 (2026-07-23)

1. Acceptance

By ticking the acceptance box and clicking "START" (or otherwise using the interactive features) on this website, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree, do not use these features.

2. Intellectual Property & Ownership

All content on this website — including but not limited to the 3D models, glTF/binary files, textures, photographs, illustrations, the "Truegiftcorp" name and logo, designs, text, layout and source code (collectively, the "Content") — is the exclusive property of Sébastien Gorge / Truegiftcorp, or used with permission, and is protected by copyright (droit d'auteur), trademark and other intellectual‑property laws in France and internationally (Berne Convention).

You acknowledge that the Content is owned by us and that nothing in these Terms transfers any ownership to you.

3. Licence & Permitted Use

You are granted a limited, personal, non‑exclusive, non‑transferable, revocable licence to view and interact with the Content on this website for your own private, non‑commercial purposes only.

4. Restrictions

Except with our prior written authorisation, you agree NOT to:

5. Digital Footprint & Proof of Ownership

The model files contain an embedded copyright notice ("copyright / droit d'auteur Sébastien Gorge 2026"). Any reproduction containing this footprint, or any copy of the Content, is evidence of unauthorised use.

6. Breach & Remedies

Unauthorised use of the Content constitutes both copyright infringement and a breach of these Terms, and may give rise to civil and/or criminal liability. We reserve the right to seek all available remedies, including injunctions, damages and takedown requests.

7. Orders, Prices & Payment

Prices are shown in euros (EUR) and include applicable taxes; shipping costs are added at checkout according to the destination zone. A binding contract of sale is formed only when your payment is captured (via PayPal) and the order is confirmed.

By placing an order you confirm that you have the legal capacity to contract and that the information you provide — in particular the delivery address — is accurate, complete and up to date. We may refuse, cancel or hold any order in the event of an obvious pricing or stock error, suspected fraud, or breach of these Terms; in such case any amount already paid is refunded to the original payment method.

Base garments & supplier availability. The blank/base garments used for our products (e.g. the t-shirts) may vary in brand, supplier, exact shade or minor specifications depending on stock and supplier availability at the time of production. We retain comparable quality and the essential characteristics (e.g. composition and the printed design), and such substitutions do not alter the nature of the product, are not considered a defect and do not give rise to a refund.

8. Shipping, Delivery & Correct Address

We dispatch to the delivery address exactly as you entered it at checkout. You are solely responsible for the accuracy and completeness of that address. We are not liable for any delay, loss or failed delivery caused by an address that is incorrect, incomplete, mistyped or no longer valid, nor for a parcel left unclaimed or refused by the recipient.

If a parcel is returned to us for such a reason, you remain responsible for the original shipping cost. Re-dispatch is possible but will be charged a new shipping fee. If you do not arrange re-dispatch within 14 days of the parcel being returned to us, we may refund the product price only — excluding all shipping costs — after deducting any charges we have incurred. For consumers, the risk of loss or damage passes to you when you (or a third party you designate, other than the carrier) take physical possession of the goods.

9. Right of Withdrawal & Returns

If you buy as a consumer at a distance, you have a statutory right of withdrawal of 14 days from the day you receive the goods, without giving a reason (art. L221-18 of the French Consumer Code), except for the items described in Section 10. To exercise it, inform us with an unambiguous statement before the deadline (email creator@truegiftcorp.com or via Instagram), then return the goods within 14 days.

To be eligible for a refund, returned items must, strictly:

We may reduce the refund to reflect any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the item, or refuse a return that does not meet the conditions above (the item may then be returned to you at your cost). Return shipping is at your expense and risk (except for a defective or non-conforming item); please use a tracked service, as we are not responsible for returns lost or damaged in transit. We recommend requesting a return authorisation first; unannounced returns may be delayed or refused.

10. Custom / Personalised Items — No Withdrawal

In accordance with art. L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to your specifications or clearly personalised. This includes our made-to-order and custom products — in particular any item for which you provide a description, message or personalisation (e.g. the "custom manifestation"; see Section 11). Such items are produced specifically for you and cannot be cancelled, returned, exchanged or refunded, except where they are defective or do not conform to the order.

11. Custom Manifestations — Unique, One-of-a-Kind Pieces

Each "custom manifestation" (and any similar made-to-order, described or personalised item) is a unique, one-of-a-kind creation produced specifically from the description you provide at the time of your order. By its very nature it is interpretive and artistic: every request results in a different piece, and no two manifestations are ever identical — even for identical or similar descriptions.

The preview image is illustrative only. Any photograph, mock-up, sample or visual shown on the product page is provided purely as an example of style and does not depict the item you will receive. Your piece will differ from the preview and from every other manifestation — in composition, layout, symbols, colours, proportions and details. Such variations are the intended characteristic of the product and are not defects, errors, or grounds for a return or refund.

Because these items are made to your specifications and cannot be resold, they are — together with Section 10 — final sale: no cancellation, return, exchange or refund, except where the item is genuinely defective or does not conform to the order. For these items, conformity is assessed solely against the written description you provided, and never against the preview image or another customer's piece. By ordering a custom manifestation, you confirm that you have read, understood and accept these characteristics.

12. Refunds, Conformity & Anti-Fraud

Where a refund is due — a valid withdrawal, or goods that are defective or non-conforming under the legal guarantee of conformity (art. L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (art. 1641 of the Civil Code) — it is issued exclusively to the original payment method used for the order (the same PayPal account). We never refund in cash, by gift card, by bank transfer to a third party, or through any other channel. A valid withdrawal refund covers the product price and the standard outbound delivery cost (excluding any express or upgraded delivery surcharge and excluding return shipping), and is processed within 14 days of our receiving the goods back or proof of their return.

Anti-fraud. We retain records of each transaction (order, payment capture, dispatch and carrier tracking) as evidence. We reserve the right to refuse a return or refund, and to contest any chargeback or claim that is fraudulent, abusive or based on false statements — including falsely reporting non-receipt of a parcel shown as delivered by tracking, "wardrobing" or serial returns, or returning a worn, used or different item. Suspected fraud may be reported to PayPal and to the competent authorities and may lead to refusal of future orders.

Nothing in this Section removes your non-waivable statutory rights as a consumer.

13. Disclaimer & Liability

The website and Content are provided "as is", without warranty of any kind to the extent permitted by law. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory rights as a consumer.

14. Governing Law & Jurisdiction

These Terms are governed by French law. Any dispute shall be submitted to the competent French courts, without prejudice to the mandatory consumer‑protection rules of the country where a consumer is habitually resident, which may grant additional rights or jurisdiction.

15. Changes

We may update these Terms at any time. The applicable version is the one identified above; continued use after a change constitutes acceptance of the updated Terms.
